法律英語中有這樣幾組特殊的詞 ， 從形式上看 ， 它們是單復(fù)數(shù)關(guān)系，但其實(shí)卻不能簡單的認(rèn)為它們是單復(fù)數(shù)關(guān)系 。比如，damage本身的含義是“損害”，而damages卻是“損害賠償金”，意思是完全不同的；還有一組security與securities，security本身是“擔(dān)保”，而securities卻是“證券”，意思也是完全不一樣的，因此大家使用的時(shí)候要特別注意 ， 不要認(rèn)為這只是單復(fù)數(shù)方面的問題 。
damage損害
XXX agrees to indemnify in full and hold harmless Sponsor and its Affiliates, employees, agents, and subcontractors from and against any loss, expense, cost, liability, damage, or claim by third parties for personal injury, including death, property damage that arises out of the negligence or willful misconduct of any XXX employee, agent, or subcontractor.
對于因XXX的任何員工、代理或分包商的疏忽或故意不當(dāng)行為導(dǎo)致的任何損失、費(fèi)用、成本、責(zé)任、損害賠償或第三方人身損害索賠，包括死亡、財(cái)產(chǎn)損失，XXX同意向委托方及其關(guān)聯(lián)方、員工、代理和分包商全部賠償 ， 并使其免受損害 。
damages損害賠償金
If any breach or violation of the provisions of Clause 11.1 occurs, the Restricted Persons and the Buyer agree that damages alone are likely not sufficient compensation and that injunctive relief isreasonable and is likely to be essential to safeguard the interests of the Buyer and of any Group Companies and that injunctive relief may (subject to the discretion ofthe courts) be obtained.
如果違反第11.1條的規(guī)定，受限人士和買方同意，僅有損害賠償金可能無法構(gòu)成充分賠償，禁令救濟(jì)是合理的 ， 對于保護(hù)買方和任何集團(tuán)公司的利益而言，禁令救濟(jì)可能至關(guān)重要，可以獲得禁令救濟(jì)（受制于法院的自由裁量權(quán)） 。
